Senegal’s Supreme Court Orders Suspension of Starlink’s Operating Licence

Senegal’s Supreme Court has ordered the provisional suspension of the operating licence granted to Starlink, SpaceX’s satellite internet subsidiary, pending the examination of a legal challenge contesting the lawfulness of the authorisation. The decision, issued as an interim measure in the context of an application for judicial review on the grounds of excess of power, does not rule on the substance of the case but freezes the licence’s legal effects until the court delivers its full ruling.

The suspension puts tens of thousands of users at risk of losing internet access, including communities in remote villages where Starlink has become the primary, and in some cases the only, available means of connectivity.

A Licence That Arrived With High Expectations

Starlink launched its satellite internet service in Senegal in February 2026, supporting the country’s goal of extending connectivity to remote and underserved areas. The government positioned the deal as a cornerstone of its digital inclusion ambitions, targeting 1 million citizens by the end of 2026.

Senegal’s Minister of Communication, Telecommunications and Digital Affairs confirmed before the National Assembly that Starlink had been granted a five-year operating licence, and that the agreement was expected to generate savings of XOF 64 billion (USD 114.7 million) for the state. The government also highlighted a social component embedded in the deal, under which one million people were to benefit from free internet access, presented as a lever for digital inclusion in areas insufficiently covered by terrestrial infrastructure.

Users in the Line of Fire

The Supreme Court’s decision does not determine the outcome of the underlying legal challenge. As the highest administrative court in Senegal, it has intervened at this stage solely to preserve the status quo while the case is examined on its merits. However, the practical consequences of the suspension are immediate for users who depend on Starlink for remote work, e-learning, telemedicine, and digital commerce, services that low-latency, high-speed satellite connectivity has made accessible in areas where fibre and mobile infrastructure remain limited.

The stakes are considerable. According to DataReportal, 23.3 million cellular mobile connections were active in Senegal by the end of 2025, equivalent to 122% of the total population, while internet penetration stood at 60.6%, with 11.5 million individuals online. The figure suggests that close to 40% of the population remains offline, a gap that satellite services such as Starlink were explicitly intended to help close.

A Pattern Emerging Across the Continent

The Senegal case adds to a broader pattern of regulatory complexity surrounding Starlink’s expansion across Africa. In Namibia, the Communications Regulatory Authority recently confirmed the dismissal of all 624 applications seeking a review of its decision to deny Starlink an operating licence, citing ownership and compliance requirements. The two cases, while distinct in their legal basis, illustrate the varied regulatory terrain Starlink continues to navigate across the continent.

The outcome of the full judicial review in Senegal will determine whether Starlink’s licence is ultimately upheld or invalidated, a decision with significant implications not only for the operator but for the country’s broader digital inclusion agenda.
